01Agreement

These Terms of Use ("Terms") govern your use of keysopendoorspodcast.com (the "Site"), operated by Keys Open Doors Podcast LLC ("Keys Open Doors Podcast", "we", "us"). By using the Site or sending us anything through it, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.

You must be at least 13 to use the Site, and at least 18 (or the age of majority where you live) to submit music, pitch a sponsorship, or enter into any arrangement with us.

02Using the Site

You're welcome to browse, watch, listen, and share links to the Site. When you use it, you agree not to:

  • Break any law, or infringe anyone's rights
  • Send spam, malware, or misleading, abusive, hateful, or harassing content
  • Impersonate anyone, or misrepresent your connection to an artist, brand, or business
  • Scrape, copy, or mirror the Site, or interfere with how it works
  • Try to access parts of the Site or our systems you're not meant to

03Our content and brand

The Site and everything on it, including the Keys Open Doors Podcast name, the logo and key emblem, artwork, episode content, text, photos, video, and design, belong to us or our licensors and are protected by copyright and trademark law.

You may view and share our content for personal, non-commercial use, as long as you credit us and link back. You may not use our name, logo, or content to sell anything, suggest we endorse you, or create merchandise without written permission.

04Messages and submissions

When you contact us through the Site, you confirm the information you send is accurate and that you're allowed to share it.

Pitches, show ideas, segment ideas, and other unsolicited suggestions are not confidential. We're always developing our own ideas, and some may be similar to yours. Unless we sign a separate written agreement, sending us an idea doesn't create any obligation for us to use it, credit it, or pay for it.

Sending a booking or sponsorship inquiry doesn't guarantee an appearance or partnership. Guest appearances and sponsorships are covered by separate written agreements or releases.

05Bass Check music submissions

Bass Check is our segment where we play new music through a real car system and give our honest take. When you submit a track, these terms apply.

You keep ownership

You keep all ownership of your music. Submitting doesn't transfer your copyrights to us.

The permission you give us

You give us a non-exclusive, worldwide, royalty-free license to play, record, reproduce, edit, excerpt, and distribute the submitted track, in whole or in part, as part of Keys Open Doors episodes, live streams, and promotional clips. This covers YouTube, Instagram, TikTok, podcast platforms such as Apple Podcasts and Spotify, this Site, and any successor platforms. It also covers using your artist name, likeness, artwork, and handles to identify and promote the segment.

Because episodes can't be re-edited once they're published, this license is perpetual for any episode or clip that has already been published. If you want us to stop using your track in future content, email us and we'll honor it going forward.

What you promise us

  • You own or control all rights needed to grant this license, for both the recording (master) and the song (composition)
  • Every sample, beat, interpolation, and featured artist on the track is cleared, and anyone with a share of the rights has agreed
  • The track doesn't infringe anyone's rights or break any law
  • You won't file copyright claims, Content ID claims, or takedown notices against Keys Open Doors content that uses your submitted track as allowed here, and you'll make sure your distributor, label, or administrator doesn't either. If an automated claim hits us, you agree to help release it promptly.

What we don't promise

We review submissions at our discretion. We don't guarantee that we'll listen to, play, or respond to every track, and we don't pay for submissions or plays. Our on-air reactions are honest opinions and may be critical. That's the point of the segment.

06Field Reporters

Field Reporters cover car shows and events and submit content to Keys Open Doors. When you apply or submit coverage, these terms apply.

Applying

Applying doesn't guarantee you'll be selected, given assignments, or published. Being a Field Reporter doesn't make you an employee, partner, or agent of Keys Open Doors, and you may not present yourself as one. You can't sign deals, make promises, or accept anything on our behalf. Any compensation, expenses, or other arrangements apply only if we agree to them with you separately in writing.

If you're under 18, a parent or guardian must agree to these Terms for you before your first assignment.

Your content and the permission you give us

You keep ownership of the photos, video, and audio you create. When you submit coverage, you give us a non-exclusive, worldwide, royalty-free, perpetual license to edit, add our branding, logos, and music to, publish, distribute, and promote it on any platform, in whole or in part. You also allow us to credit you by your name and handles. We aren't required to publish anything you submit.

What you promise us

  • The content is yours, shot by you, and doesn't infringe anyone else's rights
  • Everyone you feature agreed to appear on Keys Open Doors, and anyone under 18 had a parent or guardian's OK
  • You followed the event's rules and any instructions from organizers
  • Your content doesn't include copyrighted music, other brands' logos as overlays, or anything false, hateful, or harmful
  • You'll follow our content guidelines and act respectfully when representing the show at events

07Not professional advice

Keys Open Doors is entertainment and education. The hosts and guests share personal experiences and opinions.

Money and real estate: Nothing on the show or Site is financial, investment, tax, legal, or real estate advice. Talk to a licensed professional before making financial decisions. Past results described by anyone on the show don't guarantee future results.

Cars and builds: Vehicle restoration, modification, and car events involve real risk. Anything we show or discuss isn't professional mechanical or safety guidance. Follow manufacturer guidance and local laws, and use qualified professionals. Any work you do is at your own risk.

08Sponsors, partners, and other sites

Episodes and the Site may feature sponsors, partners, and links to other websites and platforms. We don't control them and aren't responsible for their products, services, content, or policies. Any purchase or deal you make with a sponsor or third party is between you and them. Sponsored content will be identified as required by law.

09Disclaimers

The Site and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't guarantee the Site will always be available, error-free, or secure.

10Limitation of liability

To the fullest extent allowed by law, we and our hosts, team, partners, and affiliates won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Site, the show, or anything you submit. If we are found liable for anything, our total liability is limited to $100.

11Indemnity

You agree to defend, indemnify, and hold harmless us and our hosts, team, partners, and affiliates from any claims, damages, costs, and expenses (including reasonable attorneys' fees) that come from your breach of these Terms or from anything you submit. This includes any claim that a track or coverage you submitted infringes someone else's rights.

12Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you agree to the jurisdiction of those courts.

13Changes and general terms

We may update these Terms from time to time. We'll change the date at the top, and continuing to use the Site after an update means you accept it. If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. These Terms, together with the Privacy Policy and any separate written agreement with us, are the full agreement between you and us about the Site.
